Obligations of Program beneficiaries

Within 5 years term since concluding the agreement, the beneficiary is obliged to:

  • Retain the status of the agricultural cooperative;
  • Retain the minimum number of shareholders under the Program;
  • Retain the minimum area of land plot(s) under the Program;
  • Not to alienate agricultural machinery purchased in the scopes of the Program;
  • Not to allow the transportation of agricultural machinery purchased in the scopes of the Program across the state border of Georgia.

The beneficiary is required to pledge the agricultural equipment purchased under the program as collateral in favor of the agency until all obligations under the co-financing agreement are fulfilled, within the timeframe specified by the agency.

Agricultural equipment is identifiable and is assigned a state-issued vehicle identification number, provided by the Service Agency of the Ministry of Internal Affairs of Georgia (LEPL).

The agency’s lien on the equipment can be second in rank only if the beneficiary's co-financing source is a loan from a financial institution, where the financial institution holds the first lien on the equipment as collateral.

The beneficiary is exempt from pledging the agricultural equipment in favor of the agency only if the purchase is financed through leasing.
